1. Agreement and eligibility
These Terms of Service (the Terms) are an agreement between you and SkuPeek, the operator of skupeek.com and the SkuPeek service (SkuPeek, we, or us). By creating an account, accepting a team invitation, purchasing a subscription, or using the Service, you agree to these Terms and the Privacy Policy.
The Service is intended for business and professional use, not personal or household use. You must be at least 18 years old and legally capable of entering into a contract. If you use the Service for a company or another organization, you represent that you have authority to bind it; in that case, you and Customer mean that organization.
2. The Service
SkuPeek helps e-commerce teams import and monitor their own catalog, discover potential competitor products, compare prices and stock, review product matches, and create saved reports. The Service may use automated crawling, public store interfaces, search providers, proxy networks, extraction rules, similarity systems, and artificial intelligence to produce results.
Automated matches, prices, stock states, recommendations, reports, and alerts are informational outputs. You are responsible for reviewing them before making pricing, purchasing, advertising, or other business decisions. SkuPeek does not set prices or make decisions on your behalf.
3. Accounts and teams
You must provide accurate account information, keep it current, protect account credentials and access tokens, and promptly notify us of suspected unauthorized access. You are responsible for activity carried out through your account except to the extent caused by our breach of these Terms.
Each store has an owner. The owner may invite team members up to the applicable plan limit and is responsible for their access. Team members may access store data and perform permitted actions, while Team and Billing management remain owner-only. Removing a member ends that member's store access but does not delete actions already recorded in the workspace.
4. Acceptable use
You must not, and must not allow anyone else to:
- use the Service or its outputs in violation of law or third-party rights;
- upload consumer lists, payment-card data, health data, government identifiers, or other sensitive personal data;
- monitor sources you are not legally permitted to access, request collection from authenticated or non-public areas, or use the Service to bypass access controls;
- interfere with the Service, evade plan or technical limits, introduce malicious code, probe for vulnerabilities without written permission, or access another customer's data;
- reverse engineer or copy the Service except where applicable law expressly permits that restriction to be overridden;
- resell, sublicense, or make the Service available to third parties unless an Order Form expressly permits it; or
- use pricing intelligence to coordinate prices with competitors, exchange non-public competitive information, or otherwise violate competition or antitrust laws.
We may apply reasonable technical safeguards, rate limits, and fair-use controls to protect customers, third-party sites, and Service capacity.
5. Customer Data
Customer Data means information you or your users submit to the Service, including store details, product files and URLs, catalog identifiers, match decisions, report settings, and messages. You retain your rights in Customer Data. You grant SkuPeek a worldwide, non-exclusive license to host, copy, process, transmit, and display Customer Data only as needed to provide, secure, support, and improve the Service and comply with law.
You represent that you have the rights and permissions needed for us to process Customer Data as described in these Terms. You are responsible for the legality, accuracy, and quality of Customer Data and for keeping your own source records and backups. Feedback you voluntarily provide may be used without restriction or compensation, provided we do not identify you publicly without permission.
6. Public and third-party data
The Service retrieves product and market information from public websites, search services, store interfaces, and other third-party sources. That information may be delayed, incomplete, inaccurate, unavailable, or changed by its source. SkuPeek does not claim ownership of third-party product names, images, descriptions, trademarks, or site content, and your subscription does not grant rights in them.
Source owners may restrict or change access at any time. We may stop collecting a source, remove data, or require Customer confirmation where needed to address technical, legal, or rights-holder concerns.
7. Plans and usage limits
The standard plan catalog below is current as of the effective date. Annual prices are monthly-equivalent rates billed for a full annual term. Checkout or an Enterprise Order Form shows the binding price, billing interval, currency, taxes, and any custom limits before purchase.

Each standard subscription covers one store. Monitor and Growth use standard refresh priority; Scale and Business use priority refresh; Enterprise refresh policy is custom. Business includes API, webhooks, white-label reports, custom reports, and unlimited report generation. Scale includes custom reports. Enterprise terms and features are agreed in an Order Form and Enterprise is not available through self-service checkout.
Discovery runs are separate from automatic refreshes of already-known products and approved competitor offers. Additional discovery credits may be purchased when offered. Unused included runs reset and do not roll over; separately purchased credits are governed by the terms shown at purchase. We may reject imports or disable actions that exceed the applicable limits.
8. Billing and automatic renewal
Paid subscriptions begin when the payment provider confirms payment or when we manually activate an agreed Enterprise subscription. Unless you cancel, a subscription automatically renews for successive periods equal to the selected monthly or annual billing interval, and the payment provider may charge the saved payment method at each renewal.
Prices exclude taxes unless checkout says otherwise. You authorize us and our payment provider to calculate and collect applicable charges and taxes. You must keep billing information current. Failed or overdue payment may result in retry attempts, restricted features, suspension, or cancellation. Except where prohibited by law, we may change prices for a future renewal by giving reasonable advance notice; continued use after the change takes effect constitutes acceptance of the new price.
Promotions, demos, credits, trials, and custom offers may have additional terms shown at purchase or in an Order Form. If an Order Form conflicts with these Terms, the Order Form controls for that purchase.
9. Cancellation and refunds
The store owner may disable auto-renewal or request cancellation from Billing. If an in-product cancellation control is unavailable or fails, contact [email protected]from the account email before the renewal date. Cancellation normally takes effect at the end of the paid billing period, and access continues until then unless the account is suspended for cause.
Fees already paid are non-refundable and unused time, included usage, and credits have no cash value, except where a written offer says otherwise or applicable law requires a refund. Cancelling an annual plan does not convert it to monthly billing or create a partial refund.
10. Intellectual property
SkuPeek and its licensors own the Service, software, design, workflows, documentation, and all related intellectual-property rights. Subject to these Terms and payment of applicable fees, we grant Customer a limited, non-exclusive, non-transferable, revocable right to use the Service during the subscription term for Customer's internal business purposes.
Customer may use and export reports generated for its workspace. Rights to remove SkuPeek branding or distribute white-label reports apply only when included in the selected plan or Order Form. Rights in Customer Data and third-party source material remain with their respective owners.
11. Confidentiality
Each party may receive non-public information that is identified as confidential or should reasonably be understood to be confidential. The receiving party will use it only to perform or receive the Service, protect it using reasonable care, and disclose it only to personnel and service providers who need it and are subject to confidentiality duties.
Confidential information does not include information that the receiving party can document was already lawfully known, becomes public without breach, is independently developed, or is lawfully obtained without a confidentiality duty. Required legal disclosure is permitted after notice where legally allowed.
12. Privacy and security
Our handling of personal data is described in the Privacy Policy. You must not use the Service to process personal data unless it is necessary for the permitted business use and you have provided all required notices and obtained all required rights. The Service is designed for product and business information, not sensitive personal data.
We use reasonable administrative, technical, and organizational safeguards, but no online service is completely secure. You are responsible for configuring user access, promptly removing former team members, and using secure devices and networks.
13. Third-party services
The Service relies on third-party infrastructure, payment, email, search, proxy, crawling, and artificial-intelligence services. Their outages, restrictions, source changes, and terms may affect SkuPeek. Links and access to third-party sites do not constitute our endorsement, and your direct use of a third-party service is governed by its own terms.
14. Changes and availability
We may maintain, update, add, limit, or discontinue Service features to improve the product, address security or legal issues, respond to source changes, or manage capacity. We aim to avoid materially reducing a paid plan during its current term, but do not promise uninterrupted operation or any particular source's continued availability.
Preview, beta, test, and legacy features may be changed or withdrawn at any time and are provided without service-level commitments. Any service levels or support commitments apply only if stated in an Order Form.
15. Suspension and termination
We may suspend or restrict access when reasonably necessary to prevent harm, investigate suspected misuse, respond to a legal request, protect third-party sources, address overdue payment, or enforce these Terms. We will provide notice and an opportunity to cure where reasonable.
Either party may terminate for a material breach that is not cured within 30 days after written notice, or immediately if the breach cannot be cured. You may also stop using the Service and cancel renewal at any time. On termination, access ends and we may delete Customer Data after a reasonable period, subject to legal, security, billing, backup, and dispute-resolution needs. Contact us before termination if you need to export available data.
Payment obligations and provisions that by their nature should survive, including ownership, confidentiality, disclaimers, liability limits, indemnity, and general terms, survive termination.
16. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." SKUPEEK DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED AVAILABILITY.
WE DO NOT WARRANT THAT A SOURCE CAN BE ACCESSED, THAT EVERY COMPETITOR OR PRODUCT WILL BE FOUND, THAT AUTOMATED MATCHES ARE CORRECT, OR THAT PRICE, STOCK, HISTORY, ANALYTICS, OR REPORT DATA IS COMPLETE OR CURRENT. THE SERVICE DOES NOT PROVIDE LEGAL, TAX, ACCOUNTING, OR FINANCIAL ADVICE.
17. Liability and indemnity
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, BUSINESS OPPORTUNITY, OR DATA, EVEN IF ADVISED THAT SUCH DAMAGE IS POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKUPEEK'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE FEES CUSTOMER PAID TO SKUPEEK FOR THE AFFECTED SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. THESE LIMITS DO NOT APPLY WHERE LIABILITY CANNOT LEGALLY BE LIMITED.
Customer will defend, indemnify, and hold harmless SkuPeek and its personnel from third-party claims, damages, and reasonable costs arising from Customer Data, Customer's unlawful or unauthorized use of the Service, Customer's violation of Sections 4 or 5, or Customer's violation of third-party rights. We will promptly notify Customer and reasonably cooperate; Customer may not settle a claim in a way that admits fault or imposes obligations on SkuPeek without our consent.
18. General terms
Before filing a claim, each party agrees to try in good faith for 30 days to resolve the dispute by contacting the other party. Notices to SkuPeek must be sent to [email protected]. These Terms do not select a governing law or exclusive forum; applicable law and a competent forum are determined under otherwise applicable rules unless an Order Form expressly provides otherwise.
We may update these Terms. We will post the revised version and update the effective date, and will provide reasonable advance notice of material changes when appropriate. Changes do not retroactively alter an existing dispute. Continued use after the revised Terms take effect means you accept them; if you do not agree, you must stop using the Service and cancel renewal.
Neither party is liable for delay caused by events beyond its reasonable control. You may not assign these Terms without our consent; we may assign them as part of a merger, reorganization, financing, or transfer of the Service. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest remains effective. A failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, the checkout terms, and any applicable Order Form are the entire agreement about the Service and replace prior discussions on that subject.
